Rule 34
Recommending Alternative Candidates
(1) In addition to the condition of sub-section (2) of Section 37 of the Act, the Commission shall recommend candidates in the list of alternate candidates for appointment in the order of merit in the following cases:-
(a) If the candidate recommended for appointment does not receive the letter of appointment within thirty days from the date of notification of appointment or the date of publication of the notification, but if the candidate recommended for appointment personally attends the relevant office and submits an application for non-appointment and signs it, even if the period according to this section does not exceed the period specified in this section, the alternative candidate will be appointed. (A1) If the authority cancels the appointment of the candidate recommended for appointment on the basis that he has not returned to the relevant office within the period prescribed by the prevailing law from the date of notification of appointment,
(A2) If a candidate recommended for appointment by the commission comes to know that he is ineligible according to the prevailing Nepal law at the time of recommendation, only after the recommendation is made, the recommendation of such candidate is canceled by the commission and the authority cancels his appointment.
(b) If the candidate recommended for appointment dies within one year from the date of recommendation, or resigns from the position to which he was appointed, or becomes vacant after being appointed to another position.
(2) In case of a situation as per clause (a), (a1) or (b) of sub-rule (1), the authority must inform the Commission within seven days from the date of vacancy.
(3) Notwithstanding anything written in sub-rule (2), the commission may recommend the candidate on the alternate list for appointment in order of merit if the authority does not provide the information within seven days of the vacancy. However, the commission will not recommend an alternative candidate for appointment based on the information received after one year and seven days of the recommendation for appointment.
